Cross-Examination of Hekemian Planner Concludes

Hearings proceed as usual with the continuation, and conclusion, of the public's cross-examination of Hekemian's planner.

Tuesday's hearing of the proposed development of the United Water property picked up where it left off in April--with the public's continued cross-examination of Hekemian's planner, Peter Steck.  The evening began with the attorney for the applicant, Antimo "Andy" DelVecchio, formally submitting that the conceptual contract between the developer and the Board of Education (BOE) was no longer on the table due to the results of a field study that determined the water table to be too high for the installation of a water retention system on the current location of the softball field.  In light of those findings, DelVecchio said, "The anticipated amendment to application is not going to materialize," bringing to a halt the motions by both Al …

Mr. Steck says that the site is " particularly well suited for this type of development ", as a professional planner he is sorely mistaken. The mega-supermarket should be located where highway access is readily accessible for vehicles , not where everyone driving to shop will have to drive thru surrounding residential communities on both sides of the river . A mega supermarket should not be …   more ›

Will Hekemian Offer Another Plan for a Field Donation, or is it Off the Table for Good?

The Zoning Board hearings on the development of the United Water property have been a series of twists and turns lately. What's in store for Tuesday's meeting?

Over the course of the past few months, the hearing on the proposed development of the United Water property has been filled with so many dramatic twists, turns and audible gasps that many residents are pondering what might be in store for Tuesday's meeting.  The twist began in March when Superintendent of Schools, Michael Polizzi, submitted a letter to the Zoning Board regarding the proposed development of the United Water property.  At the time, Polizzi stated that he and the Board of Education do not believe that the property should be left completely undeveloped. Although they adamantly oppose any residential building, Polizzi previously said, that a certain degree of development would be good for the community. As public debate ensued…

I am not arguing with you, my point iis is if the boe first priority was safety and there was "imminent danger" how was putting a stadium there solving the problem, it would have created more traffic and putting the students at even greater risk bc they will be going there after school, crossing busy roads, school buses from the opposing team, parents , spectators, just a traffic dangerous …   more ›

My apologies for the mis naming. However, my home is not near a flood plain. I moved into this town over 40 years ago, staying away from the Columbia St. Area. Living by the water is usually quiet, peaceful, tranquil. But I also realize the power of Mother Nature. You can't Blame the water company for her actions. The privilege of living on the water had no appeal to me.   more ›

Hekemian Rescinds Field Donation to Board of Education

Hekemian's engineers determine BOE property is not suitable for a storm water storage basin, causing developer to rescind offer.

The developer of the United Water property has rescinded its donation of three acres to the Board of Education for a field, the New Milford Schools Superintendent told a crowd that gathered in the New Milford High School auditorium Monday night. According to Michael Polizzi, Hekemian's engineers performed a geological test on the portion of the BOE's property on which they intended to build the storm water retention basin and discovered that the water table was too high. For that reason, the donation of the land was rescinded, he said.  "We regret the developer's decision as it stands today," Polizzi said.  Hekemian entered into a "conceptual contract" with the New Milford BOE to donate more than three acres of property to construct a …

I live across the street and currently have no flooding issues whatsoever. I have proof of this. If this development changes flood patterns and causes issues to my home, rest assured I'll be one of many homeowners seeking legal recourse - all from my own town who I pay taxes to for protection from such issues? If you ask me, the players in this game are clearly underestimating the intelligence of…   more ›

SOD Attending BOE Meeting Leads the Week in New Milford

SOD is getting the word out for residents to attend Monday's BOE meeting to voice their concerns regarding the BOE's conceptual contract with Hekemian for a three-acre 'Field of Dreams.'

Monday's meeting of the Board of Education may have an audience filled with more than the regular attendees. Although it is only a work session, SOD (Stop Over Development) is spreading the word for residents to attend to voice their opinion and raise concerns regarding the Board's agreement with the developer of the United Water property for a three-acre 'Field of Dreams' where the site plans currently have a storm water detention basin. During the May 14 meeting of the Zoning Board of Adjustment, the lawyer for the applicant revealed that the New Milford Board of Education (BOE) had entered into a separate agreement with the developer of the United Water property to receive a parcel of land to build a 'field of dreams.'  Antimo "Andy" …

POLL: Will 400 Additional Brookchester Apartments Strain New Milford?

Do you think with 400 additional housing units proposed for Brookchester is too much for New Milford?

While the resolution to rezone the United Water property was soundly defeated, the preliminary proposal for redeveloping the Brookchester Garden Apartment complex presented by owner Joseph Brunetti faced little public challenge upon introduction. Brunetti came before the Mayor and Council Wednesday evening to give an informal presentation and present a conceptual design of his plan to refurbish a number of existing apartments and construct approximately 400 new apartments to be housed in three or four-story units. Although the Brookchester presentation was little more than a conceptual introduction broadly detailing the intent of Brunetti, there was no questioning of the potential strain on the borough's schools, infrastructure, safety of …

Vote to Rezone United Water Property Defeated

Application will continue to run its course through the Zoning Board; Mayor says without rezoning there's little chance for conversation with the developer.

A resolution to rezone the controversial United Water property was soundly defeated Wednesday night, with council members voting along party lines.  Before an emotionally charged and divided audience that packed the Council Chambers, the resolution failed by a 4-2 vote. Republican councilmembers voted in favor of the resolution to rezone, while their Democratic counterparts voted against it.  In making her plea for rezoning the property, Mayor Ann Subrizi stressed that if the United Water application is left to run its course through the Zoning Board hearing, "it will almost certainly be appealed." "If the application is denied, it will be appealed and if the application is approved, it will be appealed," Subrizi said. "Nobody knows what …

Rezoning of United Water Property on Agenda for Wednesday's Mayor & Council Meeting

Mayor and Council will also vote on a resolution to 'express commitment to pursue rezoning and revision of the Borough’s Master Plan.'

With the Planning Board gearing up for its 10-year review of the town's master plan, talk of rezoning is on the agenda for Wednesday's Mayor and Council meeting.   According to the agenda, the Mayor and Council will be discussing the rezoning of the United Water property in both their work session that begins at 7 p.m. in the second floor conference room of Borough Hall, and also during the Public Meeting that begins at 7:45 p.m. in the Council Chambers. Additionally, Zoning Board attorney Scott Sproviero is scheduled to attend a closed session meeting with the Mayor and Council regarding potential litigation of the United Water property. Because it is a closed session matter, what that potential litigation entails has not been disclosed …

Special Meeting on Hekemian Application Ends Before It Begins

Attorneys for Hekemian request the hearing of the application be carried to June 11.

Thursday's special Zoning Board meeting on the proposed development of the United Water property did not take place as scheduled. Technically, the meeting was not cancelled; at the applicant's request, and with the Board's approval, it was carried to the June 11 regular meeting. During last week's Zoning Board meeting, Antimo "Andy" DelVecchio, attorney for Hekemian, announced that his client and the New Milford Board of Education had entered into a 'conceptual contract' whereby Hekemian is giving the BOE 3.25 acres of land along with a 'sizable' donation. As of Thursday night, representatives for Hekemian had not yet filed the amendment to the site plan application, nor had the developer submitted any renderings reflecting the donation to…
