By Diego Robalino With regards to the new plan proposed by Hekemian for the United Water property, it is clear that they are trying to work with the residents of New Milford in addressing our major concerns. Of course not every issue can be satisfactory for those in opposition, but the will of the developer is clear in trying to compromise. Compromise, meaning a settlement of differences in which each side makes concessions, is a word that naysayers will chose not to accept. Not to say that they would be wrong in doing so, but it does help to come to the bargaining table with an open mind. Is this new proposal the best plan for the property? Definitely not! Majority votes to set aside meeting with the planner on rezoning, effectively allowing the application for the development of the United Water Company property to run its course through the Zoning Board.
In a 4-2 vote, Council President Howard Berner (R) cast his vote with councilwomen Randi Duffie (D) and Hedy Grant (D), and councilman Austin Ashley (D) against proceeding with discussions with the planner regarding the rezoning the United Water Company property during Monday's Mayor and Council work session. This effectively allows the application for the development of the United Water Property to run its course through the Zoning Board of Adjustment. Despite the fact that the Borough is closed Monday, Nov. 12 in observance of Veterans Day, the Mayor and Council will be meeting for their monthly work session at 7 pm in the upstairs conference room of Borough Hall. The Zoning Board planner is scheduled to appear to discuss rezoning as well as the proposed ordinance regarding it. SOD asks for a legal determination on whether Subrizi's phone conversation to Hekemian regarding the possible rezoning of the United Water property by the Mayor and Council is legal.
Based on Zoning Board attorney Scott Sproviero's directive cautioning members of the board from speaking directly to Hekemian regarding his proposed development of the United Water property, Miriam Pickett, Executive Director of SOD (Stop Over Development), asked Borough Attorney Mark Madaio if that directive extended to Mayor Ann Subrizi's phone conversation with the developer, Peter Hekemian, during Monday's Mayor and Council work session. Mayor Ann Subrizi informed the council during Monday evening's work session that a phone call placed to Peter Hekemian revealed that if the council rezones the United Water property, the original offer he made to the town in April of 2011 is still on the table. The original offer that Hekemian made to the Mayor and Council and presented to the residents of New Milford in April 2011 included a 145-space parking lot for use by the borough and school district, and a graded field that could be developed into a soccer field, as well as a new Shoprite, a family restaurant, bank and 10,000 square feet of commercial space for local merchants.
