Councilwoman Grant Withdraws Lawsuit to Invalidate Appointment of Borough Attorney

Grant's statement on withdrawing lawsuit petitioning to the court to invalidate the appointment of Marc Leibman as Borough Attorney.

Editor's note: In February, Councilwoman Hedy Grant filed a lawsuit against Councilman Austin Ashley, Mayor Ann Subrizi and the Borough of New Milford petitioning the court to invalidate the appointment of Borough Attorney, Marc Leibman. Grant sought a judicial determination that Ashley had a "disqualifying conflict of interest" by nominating and voting on the appointment of Leibman. Supporting documentation contended that Grant believed Leibman's appointment to be nothing more than 'pay to play' whereby Ashley's nomination and vote for Leibman as Borough Attorney represented payment for Leibman's legal services provided to Ashley. Judge Denies Grant's Lawsuit to Remove Leibman as Attorney

Bergen County Superior Court Judge Joseph Conte issued a one-page decision denying Councilwoman Hedy Grant's lawsuit to remove Marc Leibman as Borough Attorney

A Bergen County Superior Court judge has ruled against Councilwoman Hedy Grant's lawsuit to remove Marc Leibman as borough attorney in a March 19 ruling. The decision came days after attorneys for Grant, Leibman, Mayor Ann Subrizi and the borough argued before Judge Joseph Conte the merits of Grant's lawsuit. Conte's one-page decision stated that Grant's Order to Show Cause "seeking temporary restrains and the invalidation of the appointment of municipal attorney is hereby denied." Grant's lawsuit, which was filed in February, called for the court to invalidate the appointment of Borough Attorney Marc Leibman on the basis that his prior representation of Councilman Austin Ashley regarding the potential development of the United Water …

Mark Flores. The new council, as you know was 4-2 dem majority. It is a forgone conclusion that with control the Dems are going to hire a Dem attorney so the former attorney didnt even apply for the job. he was not even in attendance. at the reorg, last years attorney is dismissed prior to a new attorney being hired.I don't know how the Reps stay out of voting for an attorney or how they would …   more ›

Court Decision on Grant's Lawsuit Coming Next Week

Councilwoman Hedy Grant's lawsuit to remove Borough Attorney Marc Leibman went before Superior Court Judge Joseph Conte on Friday afternoon.

Listening to arguments from several attorneys, Superior Court Judge Joseph Conte announced that he will issue a decision sometime next week on Councilwoman Hedy Grant's lawsuit to remove Marc Leibman as the borough attorney. Grant's lawsuit, which was filed in February, called for the court to invalidate the appointment of Borough Attorney Marc Leibman on the basis that his prior representation of Councilman Austin Ashley regarding the potential development of the United Water property by the S. I agree that this is exactly the issue this matter rests upon, Ulises. If Liebman gave free or discounted services to Ashley - even if not explicitly anticipating some future benefit - it would appear to be a re-payment of those services (in the form of a retainer at public expense) for Ashley to recommend him for Boro atty.   more ›

Councilwoman Grant Makes Motion to Rescind Appointment of Borough Attorney

Borough Attorney says there is no conflict of interest; motion fails with Mayor's tie-breaking vote.

Citing "the appearance of a conflict of interest," Councilwoman Hedy Grant placed a motion before the Mayor and Council requesting that the appointment of Marc Leibman as Borough Attorney be rescinded. Leibman had represented Councilman Austin Ashley before the Zoning Board against Hekemian in the potential development of the United Water property. The motion was seconded by Council President Randi Duffie. "All ethics rules say we must keep the faith of the public trust," Grant said. "A breach of the public trust is the ultimate failing of a governing body." Leibman responded to the motion by saying that there is no conflict of interest in his representation of the borough.
