Editor's note: In February, Councilwoman Hedy Grant filed a lawsuit against Councilman Austin Ashley, Mayor Ann Subrizi and the Borough of New Milford petitioning the court to invalidate the appointment of Borough Attorney, Marc Leibman. Grant sought a judicial determination that Ashley had a "disqualifying conflict of interest" by nominating and voting on the appointment of Leibman. Supporting documentation contended that Grant believed Leibman's appointment to be nothing more than 'pay to play' whereby Ashley's nomination and vote for Leibman as Borough Attorney represented payment for Leibman's legal services provided to Ashley. Bergen County Superior Court Judge Joseph Conte issued a one-page decision denying Councilwoman Hedy Grant's lawsuit to remove Marc Leibman as Borough Attorney
A Bergen County Superior Court judge has ruled against Councilwoman Hedy Grant's lawsuit to remove Marc Leibman as borough attorney in a March 19 ruling. The decision came days after attorneys for Grant, Leibman, Mayor Ann Subrizi and the borough argued before Judge Joseph Conte the merits of Grant's lawsuit. Conte's one-page decision stated that Grant's Order to Show Cause "seeking temporary restrains and the invalidation of the appointment of municipal attorney is hereby denied." Councilwoman Hedy Grant's lawsuit to remove Borough Attorney Marc Leibman went before Superior Court Judge Joseph Conte on Friday afternoon.
Listening to arguments from several attorneys, Superior Court Judge Joseph Conte announced that he will issue a decision sometime next week on Councilwoman Hedy Grant's lawsuit to remove Marc Leibman as the borough attorney. Claims Planning Board denial of its application to move to New Milford was "unreasonable" and violated federal law protecting religious institutions.
The Gospel Fellowship Church, a primarily Korean congregation whose application to move into the former Riverview Racquetball Club building was denied, has filed a lawsuit in Superior Court appealing the decision of the Planning Board. The church, currently located in Bergenfield, wants to move into the Riverview Racquetball Club facility on Henley Ave., but was denied by the Planning Board in December. The board cited increased flooding, traffic and the number of congregants as reasons for denial. Elliot Urdang, a land use and zoning attorney who is representing Gospel Fellowship Church in the lawsuit, told Patch that the complaint contains two counts.
