Judge Denies Grant's Lawsuit to Remove Leibman as Attorney

Bergen County Superior Court Judge Joseph Conte issued a one-page decision denying Councilwoman Hedy Grant's lawsuit to remove Marc Leibman as Borough Attorney

A Bergen County Superior Court judge has ruled against Councilwoman Hedy Grant's lawsuit to remove Marc Leibman as borough attorney in a March 19 ruling. The decision came days after attorneys for Grant, Leibman, Mayor Ann Subrizi and the borough argued before Judge Joseph Conte the merits of Grant's lawsuit. Conte's one-page decision stated that Grant's Order to Show Cause "seeking temporary restrains and the invalidation of the appointment of municipal attorney is hereby denied." Grant's lawsuit, which was filed in February, called for the court to invalidate the appointment of Borough Attorney Marc Leibman on the basis that his prior representation of Councilman Austin Ashley regarding the potential development of the United Water …

Court Decision on Grant's Lawsuit Coming Next Week

Councilwoman Hedy Grant's lawsuit to remove Borough Attorney Marc Leibman went before Superior Court Judge Joseph Conte on Friday afternoon.

Listening to arguments from several attorneys, Superior Court Judge Joseph Conte announced that he will issue a decision sometime next week on Councilwoman Hedy Grant's lawsuit to remove Marc Leibman as the borough attorney. Grant's lawsuit, which was filed in February, called for the court to invalidate the appointment of Borough Attorney Marc Leibman on the basis that his prior representation of Councilman Austin Ashley regarding the potential development of the United Water property by the S. Hekemian Group created a conflict of interest. Her suit further stated that Ashley was "disqualified by self-interest" from voting for the appointment of Leibman as Borough Attorney. Grant Files Suit to Remove Borough Attorney, Claims 'Pay to Play'

Grant petitions the court to invalidate the appointment of Marc Leibman as Borough Attorney citing conflict of interest and 'pay to play.'

Councilwoman Hedy Grant has filed a lawsuit against Councilman Austin Ashley, Mayor Ann Subrizi and the Borough of New Milford petitioning the court to invalidate the appointment of Borough Attorney, Marc Leibman of the law firm Kaufman, Semeraro, Bern, Deutsch & Leibman. The complaint, filed in Superior Court in Hackensack, submits that as Leibman's client in the matter before the New Milford Zoning Board regarding the potential development of the United Water property by the S. Hekemian Group, Ashley was "disqualified by self-interest" from voting for the appointment of Leibman as Borough Attorney. If Liebman gave free or discounted services to Ashley - even if not explicitly anticipating some future benefit - it would appear to be a re-payment of those services (in the form of a retainer at public expense) for Ashley to recommend him for Boro atty.   more ›

Grant Proposes Resolution Supporting Ban of Assault Weapons

In light of Newton massacre, Councilwoman Grant proposes a resolution supporting legislation banning the sale of assault weapons and large-capacity magazines to private citizens.

Emphasizing that there have been more than 70 mass shootings in the United States since January 2011, Councilwoman Hedy Grant proposed a resolution to reduce gun violence in the United States by banning the sale, use and transfer of assault weapons and large-capacity magazines to private citizens. Grant's resolution is in support of federal legislation on gun safety reform that includes the sale of high-capacity magazines. Grant contends that if the Supreme Court makes distinctions with respect to types of speech under the First Amendment, then it should also make distinctions among types of weapons under the Second Amendment. Mayor and Council unanimously approve anti-semitism resolution

The Mayor and Council unanimously approved a resolution condemning anti-Semitism during Monday's work session, making New Milford the first municipality in Bergen County to pass such a measure. The resolution, sponsored by Councilwoman Hedy Grant, is a response to a string of anti-Semitic incidents that recently occurred in Bergen County.
