Kiene found the group, including the man the mother described on River Edge Avenue. NMPD officers questioned Ortenzio and said they "detected a strong odor of an alcoholic beverage emanating from his breath."

The boy's mother signed a complaint against Ortenzio who was then brought to NMPD headquarters, according to police. Ortenzio was read his Miranda rights and refused to answer any questions.
